ISOLATION OUTFITTERS TERMS AND CONDITIONS

Isolation Outfitters Limited (referred to collectively as ‘Isolation Outfitters’, ‘we’, ‘us’, ‘our’) provides specialist fly fishing travel planning and arrangement services (‘Services’). These Terms and Conditions (‘Terms and Conditions’, ‘Terms’) outline the terms and conditions governing your rights and responsibilities when purchasing our Services and as posted on our website found at www.isolationoutfitters.com (‘Site’).

GENERAL TERMS

Please read these Terms and Conditions carefully. These Terms form a legally binding agreement between you and Isolation Outfitters. By placing an order with us you agree to comply with and be bound by the terms as outlined in these Terms and Conditions. These Terms define your rights and responsibilities related to your purchasing of Services from us. These Terms constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all previous written or oral agreements between the parties with respect to such subject matter. These Terms remain effective until terminated.

ACCEPTANCE OF TERMS

By purchasing any trip arrangement services from us, you expressly acknowledge, represent and agree that you are at least 18 years old and have read, understand and agree to these Terms and accept that these Terms are legally binding and will abide by these Terms and all applicable laws and regulations.

UPDATING TERMS AND CONDITIONS

We reserve the right, at our discretion, to change, delete, and update these Terms and Conditions and any related policies at any time, for any reason, and in our sole discretion. We also reserve the right to discontinue any Services, any portion of the Services, any products, and/or to terminate your access to or use of our Services. It is your responsibility to periodically review these Terms and Conditions for changes. Any amendments or modifications we make will be effective upon posting on the Site. Your continued access or use of the Site after these Terms and Conditions have been updated constitutes your acceptance of such changes.

DEPOSIT AND BALANCE PAYMENTS

  1. A 50% deposit (‘Deposit’) per angler of the total package cost for each trip is due to Isolation Outfitters at the time of booking to secure your trip reservation. This Deposit is non-refundable unless the lodge and/or guides providing the trip activities and accommodation have conditions of service that allow for refundable deposits.

  2. If Deposits are not paid within seven days of the booking being advised to Isolation Outfitters, the trip is deemed to be cancelled and can be offered to a third party to accept the availability created by the non-payment of the Deposit by the original party booking the trip space.

  3. Date changes to trips that are already booked are subject to availability and must be approved and accepted by all the suppliers involved in supplying the trip services including the lodges, accommodation providers, airlines or other transport, guides and any contracted staff or resources to be used. Some suppliers may not be able to offer any suitable date changes.

  4. Isolation Outfitters reserves the right to charge a handling fee of US$200.00 per person for any date changes after the initial reservation has been made and after the Deposit has been paid.

  5. Full payment (‘Balance’) for all trips booked through Isolation Outfitters is due 90 days prior to trip commencement.

  6. Isolation Outfitters applies a 2.9% convenience fee for all credit card transactions. This is in line with what we are charged to process these payments.

  7. Where the number of attendees changes before the Balance becomes payable, the full balance remains unchanged. When a trip is invoiced as double occupancy and is changed to single occupancy due to one angler seeking to cancel then the trip invoice will revert to single occupancy at the same price as for double occupancy.

QUOTED TRANSACTIONS

Prices quoted are based on foreign exchange values and any duties, government fees or tariffs currently in effect, and all prices are subject to change at any time.

Isolation Outfitters reserves the right to refuse or limit any booking request for any reason. If there are change/s to the quoted price for accommodation, airlines, transfers or other items that are priced with variable or surge pricing BETWEEN the date of the quote being offered and the date of expected Deposit payment, we will advise of these price changes and you agree to either build any price difference into the final Balance payable or not to proceed to book the trip by withholding your Deposit payment.

If there are change/s to the quoted price for accommodation, airlines, transfers or other items that are priced with variable or surge pricing AFTER confirmation of Deposit payment and before bookings with these suppliers are confirmed, you agree for these price changes to be included in the final calculation of your Balance payment.    

SECURE PAYMENTS

Our preferred and secure forms of payment are:

  • Secure Payment Link via US Domestic Bank for Electronic Funds Transfer (EFT/ACH)

  • Secure Payment link (via the Stripe platform) for all Credit Card payments

  • Payment via Wire or SWIFT for any international transactions to our US or NZ-domiciled Banks

US-domiciled and Canada-domiciled payments are made through direct bank transfer or credit card payment to Isolation Outfitters in US currency.

Payments from all other countries are made to Isolation Outfitters in US currency or in the local currency by arrangement or as converted into local currency within the Secure Payment Link we have provided by the operator of the payment services.

TRIP CANCELLATION BY ISOLATION OUTFITTERS

Isolation Outfitters in its sole discretion reserves the right to:

  1. make such alterations in the trip itinerary as it deems necessary or desirable,

  2. to refuse to accept or retain as a customer, any person at any time (in such case refund will be based on the actual cost of the unfinished portion of the trip), and

  3. to pass on to customers all expenditures occasioned by delays or occurrences beyond the control of Isolation Outfitters.

Isolation Outfitters reserves the right in its sole discretion to cancel any trip prior to departure, in which case full refunds will constitute full settlement to any customer.

PRIVACY

We are committed to transparency in how we collect, use, and share data. The terms of our Privacy Policy apply to your use of the Site and access to our Services. It is your responsibility to read and understand our Privacy Policy, which we may update from time to time.

CONTENT RIGHTS

All Materials accessible on the Site are owned by Isolation Outfitters or supplied to us for use by the lodges and guides we work with. You may not copy, distribute, modify, or use these Materials without our prior written consent.

Isolation Outfitters respects the intellectual property of others. If you believe that intellectual property owned by you or a third party has been copied or used on the Site in any way that constitutes copyright infringement or other intellectual property infringement, please contact us at office@isolationoutfitters.com for notification of claims, providing all relevant information.

LIMITED LICENSE

Subject to our Terms and Conditions, we grant you a limited, non-exclusive license to access and use the Site for your non-commercial, personal, and informational use and/or to obtain products, services, rewards, or information from us. You may NOT USE any part of the Site for commercial purposes, to compete with us, or to harm us in any way.

INFORMATION SECURITY

When you provide us with any information online for any reason, you understand and expressly agree that there is a risk of fraud or security breach. We disclaim all warranties that such transactions will be error-free or may not be subject to third-party security breaches. You waive all claims relating to the same.

EMAIL COMMUNICATIONS

When you engage with our Services, we may add you to our database for announcements or offers that we chose to share from time to time with a limited group of interested anglers. You acknowledge that by engaging with our Services, we will add your email and other relevant contact information to our secure database for this purpose. You may choose to opt out of our email marketing by using the Unsubscribe link that is at the base of every marketing email we dispatch.

DISCLOSURE OF YOUR IDENTITY AND USE

We reserve the right to disclose your information as necessary to comply with laws, protect our rights, or respond to legal requests.

DISCLAIMERS AND LIMITATION OF LIABILITY

Your use of our Services and our Site is at your own risk. To the extent permitted by law, Isolation Outfitters disclaims all warranties and liability for damages, including indirect or consequential damages, resulting from your use of our Services and accessing our Site.

INDEMNIFICATION

You agree to indemnify and hold harmless Information Outfitters and its affiliates from claims, liabilities, or expenses arising from your use of our Services or violation of these Terms and Conditions.

Isolation Outfitters shall not be liable for any nonperformance or delay in performance caused by any act or event beyond its reasonable control, including without limitation acts or omissions of Third Parties, unavailability of supplies or labor, equipment failure, war, strikes, lock-outs, fire, flood, earthquake, hurricane, disease, epidemic, pandemic, plague, quarantine, any other Act of God, any law, regulation, ordinance, or other act or order of any court, government, or governmental agency.

Baggage and personal effects of you (‘Customer’) are always the sole responsibility of you as the Customer and no agent of Isolation Outfitters is authorized to accept these for storage, safekeeping, or transportation.

You agree to comply with any codes, laws, orders, ordinances, regulations, and statues of any government authority for any trip destination including layovers.

APPLICABLE LAW

As Isolation Outfitters Limited is a New Zealand-based limited liability company, these Terms and Conditions are governed by the laws of New Zealand. For the avoidance of doubt, all trips offered by Isolation Outfitters are planned and arranged by Isolation Outfitters Limited unless explicitly documented as having been provided by any other party.

Isolation Outfitters LLC is a limited liability company incorporated in Missoula, Montana, USA. Where any Services have been provided and documented explicitly as being planned and arranged by Isolation Outfitters LLC and where payment has been made directly to Isolation Outfitters LLC into accounts owned and operated by Isolation Outfitters LLC, then these Terms and Conditions shall be subject to and enforced in accordance with the laws of Montana USA.
